Right to Rent checks without turning the viewing into an interrogation

You are supposed to check every adult. You are not supposed to guess nationality from an accent. Those two sentences are the whole job, and people still mix them up.

Right to Rent is a Home Office job that landlords in England got handed with a leaflet and a threat. You must check that every adult occupying the property as their only or main home has a right to rent. You must do it the same way for everyone. You must not play amateur immigration officer based on someone's name or accent.

Get that last part into your bones. Discrimination claims are not a myth, and "I was only being careful" is not a defence if you only asked the Nigerian applicant for extra papers.

How to do the check without the theatre

Ask every adult applicant for the same thing, in the same order. Original documents or the official online route, in their presence or through the prescribed service. Copy what you are allowed to copy. Record the date. If someone cannot show a right to rent, you cannot let to them. That is the law. It is also why you should not take a holding deposit until you know the check will pass.

Lodgers in your own home have slightly different edges. Joint tenants who later invite a partner to move in are a classic trap. The new adult needs a check too. "They are just staying for a bit" is how unofficial occupants appear, and you still have a duty.

Follow-up checks

Unlimited right, British passport, you file it and move on. Limited leave means a calendar reminder. Missing a follow-up is the boring way to get a penalty. Put the date next to the tenancy, not in your head.

What not to do at the viewing

  • Do not ask only some people where they were born.
  • Do not refuse to view because the surname "looks foreign".
  • Do not accept a blurry photo of a passport in a group chat as a completed check.
  • Do not keep copies you have no reason to keep after the process allows destruction.

Penalties and the rest of the file

Civil penalties can be large. Repeat breaches look worse. The Home Office is not your only audience. A clean Right to Rent record sits beside gas, electrics, and the deposit pack as part of looking like you run the property on purpose.

Keep the copies with the tenancy record. When a tenant leaves, follow your retention rules rather than hoarding identity documents forever. Data protection still applies while you are busy being a border guard you never asked to be.
